Supreme Court Upholds Racing NSW 18 Month Disqualification Of James McDonald

The Supreme Court of NSW handed down a judgment this morning in favour of Racing NSW regarding jockey James McDonald’s appeal of his 18 month disqualification. The 18 month disqualification was previously applied for a breach of AR83(d).

Justin Gleeson SC appeared with James McCleod for Racing NSW and Bret Walker SC appeared with Timothy Boyle for James McDonald. Judge Rein heard arguments from both sides and preferred the views of Racing NSW, holding that the previously imposed penalty of an 18 month disqualification should stand, dismissing the Summons and ordering that Mr McDonald pay the costs of Racing NSW.
