Racing Appeals Tribunal - Dennis Mitchell (Withdrawal Of Further Appeals)

Racing NSW lodged an appeal with the NSW Racing Appeals Tribunal against the decision on jurisdiction on 22 August 2017 from the Racing NSW Appeal Panel. This Appeal was heard on Friday, 25 May 2018 commencing at 2pm at the offices of Racing NSW.

Separate additional appeals by Racing NSW and Mr Mitchell against the findings of the Appeal Panel had been deferred pending the outcome of the appeal on jurisdiction.

On 4 June 2018, the Tribunal handed down its decision, upholding the appeal on jurisdiction regarding Stewards’ powers to investigate, charge and penalise particularised conduct under AR175A.

The Tribunal also issued directions for future conduct of the additional appeals.

On 14 October 2018, the Tribunal agreed to a request from both appellants to withdraw the balance of appeals after the parties had reached agreement to dispose of the matter on a final basis and sought the leave of the Tribunal to withdraw all remaining live appeals by consent.

The Tribunal further ordered that the Appeal Deposit be refunded.

The matter is now concluded.
