Appeal Updates (Clipperton, O'Hara, Duckworth)

Please note the following updates in regards to appeals:-

Sam Clipperton
Licensed jockey Sam Clipperton lodged an Appeal against conviction and penalty after being found guilty by the Stewards under AR129(2) after his ride on Irish Songs in Race 3 (The Everest Carnival Handicap, 1100m) on the Kensington Track on Saturday, 17 August 2019. Following a Stewards inquiry conducted on Wednesday, 4 September 2019, Mr Clipperton was suspended for a period of one month commencing Thursday, 12 September 2019 and to expire on Saturday, 12 October 2019, on which day he may ride. On application of the Appellant, which was not opposed by the Stewards, the Principal Member granted a Stay of Proceedings. This Appeal was heard on Wednesday, 25 September 2019 commencing at 9am.

The Panel gave the following orders:

  1. Appeal against finding of breach of AR129(2) dismissed
  2. Finding of breach of AR129(2) upheld
  3. Appeal against severity of penalty allowed
  4. In lieu of a four-week suspension, the appellant is penalised by a three-week suspension, such penalty is to commence on Saturday, 28 September 2019, and to expire on Saturday, 19 October 2019, on which day the appellant may ride
  5. Appeal deposit to be forfeited

Kathy O’Hara
Licensed jockey Kathy O’Hara lodged an Appeal against penalty after pleading guilty to a charge under AR218(4)(c) after she was found being in the possession of and using her mobile telephone whilst in the jockeys' room. Following a Stewards inquiry conducted on Tuesday, 10 September 2019, Ms O’Hara was suspended for a three-month period commencing on Friday, 20 September 2019 and to expire on Friday, 20 December 2019, on which day she may ride. This Appeal was heard on Wednesday, 25 September 2019 commencing at midday.

The Panel gave the following orders:

  1. Appeal against severity of penalty allowed
  2. In lieu of a three-month suspension, the appellant is penalised with a five-week suspension, such penalty commenced on 20 September 2019 and to expire on 25 October 2019, on which day the appellant may ride
  3. Appeal deposit to be refunded

Charlie Duckworth
Licensed foreperson Charlie Duckworth lodged an Appeal after pleading guilty to a charge under AR227 in that he was a party to licensed jockey Ms Kathy O’Hara breaching AR218(4)(c) at 29 race meetings when Ms O’Hara was present in the jockeys' room by engaging in telephone communication with Ms O’Hara. Following a Stewards inquiry conducted on Tuesday, 10 September 2019, Mr Duckworth was fined $2000. This Appeal was heard on Wednesday, 25 September 2019 commencing at 2pm

The Panel gave the following orders:

  1. Appeal against severity of penalty allowed
  2. In lieu of a fine of $2000, a $500 fine is imposed
  3. Appeal deposit to be refunded
