The Racing Appeals Tribunal has determined appeals lodged by licensed trainer Mr John O’Shea and Racing NSW arising from charges issued against Mr O’Shea following an incident at Rosehill Gardens Racecourse on 21 February 2026.

Mr O’Shea had pleaded guilty to three charges under the Australian Rules of Racing, being one charge under AR 228(b) and two charges under AR 228(c), arising from his conduct towards Racing NSW Official Veterinarians following the scratching of Bev’s Nine from Race 3 at Rosehill Gardens.
Racing NSW Stewards originally imposed a four-month disqualification. On appeal, the Racing NSW Appeal Panel reduced the penalty to a two-month disqualification.
Mr O’Shea appealed to the Racing Appeals Tribunal against the penalty imposed by the Appeal Panel. Racing NSW also appealed, seeking the re-imposition of the original four-month disqualification.
The Tribunal dismissed Mr O’Shea’s appeal and upheld Racing NSW’s appeal. The Tribunal quashed the Appeal Panel’s decision and imposed a disqualification of four months in respect of each charge, to be served concurrently, commencing on 17 March 2026.
Accordingly, Mr O’Shea is disqualified for a total period of four months.
